General Purchase Conditions
These Specific Conditions of the Purchase Contract apply to online sales made through the website https://www.rociogago.com (hereinafter, WEBSITE) whose ownership corresponds to Rocio Gago Molina with address at Av San Luis 93, 28033, Madrid.
In cases of sales outside the national territory, the international online sales conditions will apply.
The use by the client of the services proposed on the WEBSITE presupposes, in any case, the acceptance of these Specific Conditions of the Online Purchase Contract, in the version published by Rocio Gago, at the time of the purchase order. Therefore, it is advisable that the customer read these Specific Conditions before proceeding to make a purchase, as well as the general terms and conditions of use of the portal.
We also ask you to read our Privacy Policy before placing your order. By using this WEBSITE or placing an order through it, the customer agrees to be bound by these Conditions and our Privacy Statement, so if you do not agree with all the Conditions and the Privacy Statement, You should not place any order.
1. Object of the contract
These particular online purchasing conditions apply to the purchase of any product present on the WEBSITE made by customers who have their delivery address in Spain, and abroad.
The prices of each of the jewelry and accessories are indicated on the website on the date the order is placed. Prices are detailed for each item including taxes and fees. The amount of shipping costs and any other service is also specified and will be indicated to the customer in detail at the time they place the order.
The purchase service through the WEBSITE regulated in these Specific Conditions only allows the purchase of products and services to customers over 18 years of age.
Rocio Gago reserves the right to cancel a client's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
Rocio Gago will modify and update, if it deems appropriate, articles and prices in accordance with the company's commercial criteria, although the changes will not affect the products that have been accepted.
All product orders are subject to their availability and, in this sense, if there are difficulties regarding their supply, or if there are no items left in stock, the order will be canceled and any amount that the customer could have paid or reached an agreement within the delivery period with the client.
2. Hiring procedure
This information and details contained on the WEBSITE do not constitute an offer to sell, but rather an invitation to do business. No contract will exist between the customer and Rocio Gago in relation to any product until the order has been expressly accepted by Rocio Gago (even if the customer's account has already been charged). If the offer is not accepted and a charge has already been made to your account, the amount will be refunded to the client in full.
To place an order, the customer must follow the online purchasing procedure and click on "Place order". After this, you will receive an email acknowledging receipt of your order (Order Confirmation). It should be noted that this does not mean that your order has been accepted, since it constitutes a mere offer to Rocio Gago to purchase one or more products. All orders are subject to acceptance by Rocio Gago, who will confirm such acceptance by sending an email informing you that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between Rocio Gago and the client (Contract) will be formalized only when the Shipping Confirmation with its corresponding order information is sent to said client.
Only those products listed in the Shipping Confirmation will be the subject of the Contract. Rocio Gago will not be obliged to supply any other product that may have been ordered by the customer until its shipment is confirmed in an independent Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism) that require us to reject the processing of an order after having sent the Order Confirmation. . Rocio Gago reserves the right to do so at any time, at its sole discretion.
3. Obligations of the parties
3.1. Pay
The price of the products will be the one stipulated at all times on the WEBSITE, except in the case of obvious error. Although Small Affaire tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If Rocio Gago discovers an error in the price of the products that the client has ordered, Rocio Gago, after informing the client as soon as possible, will proceed to cancel the order. If Rocio Gago is unable to contact the customer, the order will be considered canceled and the amounts that have been paid will be fully refunded.
Rocio Gago is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in the price is obvious and unequivocal and could have reasonably been recognized by the customer as an incorrect price.
Prices for Rocio Gago products may vary, but (except as stated above) possible changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the particularities of online purchasing, the price of the products indicated on the WEBSITE refers solely and exclusively to the purchases made there, without necessarily coinciding with the retail price of the Rocio Gago establishments. In accordance with the above, the price indicated on the WEBSITE is only considered binding for online purchases.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in a breakdown.
Once the customer has made their purchases, all the items they wish to purchase will have been added to their bag and the next step will be to process the order and make payment. To do so, the client will follow 6 steps:

For orders destined for Ceuta and Melilla, deliveries will be exempt from VAT without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of them.
3.2. Delivery
The shipment will be made through the Tipsa company outside of Rocio Gago, which undertakes to deliver the product paid by the customer to the delivery address within an approximate period of 24-48 hours for national shipments and 1-15 days for international shipments from the moment when it leaves our logistics center:
For purchases over €150 with delivery in Spain (peninsula and Balearic Islands) shipping costs will be borne by Rocio Gago.
You can check the status of your shipment at all times in our virtual tracking that you receive in your email.
During special sales periods such as sales, outlets, promotions or Christmas, shipping times may be increased.
The agency's problems when delivering to the client's home are beyond the control of the Rocio Gago company. Please contact the shipping company Tipsa with the tracking number that you receive in your email automatically when your order is shipped.
These delivery times may be extended up to 45 days for some of the following reasons:
- Product customization.
- Special items.
- Pre-sale items
- Unforeseen circumstances not attributable to Rocio Gago.
- Product out of stock or pre-sale.
If for any reason the delivery of the order is delayed for several days, in addition to the expected deadline, we will inform you of this circumstance through our virtual tracking. It must be taken into account in any case that deliveries are not made on Saturdays or Sundays.
For the purposes of these Conditions, it will be understood that delivery has occurred or that the product(s) have been delivered at the time of signing for receipt of the same at the agreed delivery address.
If it is impossible to deliver the order due to the absence of the User, the order could be returned to the warehouse. However, the carrier will leave a notice explaining where the order is located and how to have it delivered again, whether it is a physical notice (paper) or telephone notice (call or message).
For shipments within the national territory, if 30 days have passed since your order is available for delivery, and it has not been delivered for reasons attributable to the User, Rocio Gago will understand that the User wishes to withdraw from the purchase. As a consequence, all payments received from the User will be returned, with the exception of shipping costs, costs derived from the cancellation of the purchase and additional costs resulting from the User's own choice of a delivery method other than the least expensive method. cost of ordinary delivery offered by the Website, without any undue delay and, in any case, within a maximum period of 14 days from the date on which the contract is considered terminated.

Currently Rocio Gago does not ship to the Canary Islands, Ceuta, Melilla or Andorra. In the event that shipments to the Canary Islands, Ceuta and Melilla are activated again or shipments are made to countries outside the community customs union, the customer must pay customs fees. In this case, delivery times may be extended up to 45 days for some reasons or unforeseen circumstances not attributable to Rocio Gago. It must be taken into account in any case that deliveries are not made on Saturdays, Sundays or holidays.
In the event that customs deems it necessary or detains the package, the recipient will be responsible for paying processing costs. This condition is accepted when making the purchase. In the event that the item reaches its destination and the customer refuses to pay customs and processing fees, the package is returned to the Rocio Gago logistics center and this amount will be deducted from the return of the product.
In any case, the User, before clicking on "COMPLETE PURCHASE", has access to the space, cart, or basket where their purchase requests are recorded and viewing the shipping information.
4. Withdrawal
The customer has the right to withdraw from the contract within FOURTEEN (14) calendar days following delivery of the order.
The User acknowledges knowing that there are exceptions to the right of withdrawal. By way of example, and not exhaustive, this would be the case of: used products, personalized or custom-made products; products without their packaging as sealed in the factory; products that for hygiene or health reasons are sealed and have been unsealed after delivery, products such as earrings, piercings or fragrance for health and hygiene reasons according to the regulations of the Ministry of Health, and discounted products or products purchased during the discount period. and special sales. ATTENTION: Due to safety and hygiene reasons, we cannot accept exchanges or returns on earrings.
In any case, no refund will be made if the product has been used or for products that are not in the same conditions in which they were delivered or that have suffered any damage after delivery. Likewise, the products must be returned using or including all their original packaging, the completed return form and other documents that may accompany them.
Once the withdrawal has been formalized and the item has been returned along with its original packaging and the brand seal in perfect condition, the amount will be refunded in the shortest possible time, and in any case, within fourteen calendar days following the moment in which that Small Affaire has been aware of the customer's withdrawal and has received the product. All payments received will be refunded to you, except delivery costs. The means used for the return will be the same by which the payment was made.
In the case of orders in the Canary Islands , Ceuta and Melilla and countries outside the community customs union, as well as international shipments, the customer must send the shipment to the Rocio Gago logistics center. 5. Existence of warranty
Given the special characteristics of the products sold by Rocio Gago on its website, there are slight differences between each product or service purchased, due, fundamentally, to the uniqueness and exclusivity of each and every one of the materials and stones used in its preparation that It is also, to a large extent, artisanal. Therefore, no two products are exactly the same and, in any case, it is inevitable that the product delivered to the customer will differ slightly from that shown in the photographs included in the website purchase process (even if it had been the same). In no case will these differences imply the delivery of products or services with worse quality of materials than those expressly mentioned on the portal or website. Likewise, the client is informed and is aware that the size of the photographs contained on the portal does not correspond to the real size of the products offered.
Therefore, the client is informed and expressly consents to these circumstances and differences, without them being a cause for termination of the Contract.
In any case, without prejudice to what is established at the beginning of the section, the Rocio Gago products purchased by the client through the purchase procedure established on the website have the legal guarantee typical of consumer goods, that is, their compliance with its description on the website and with these Particular Conditions.
The guarantee relating to damage caused by improper use is excluded, as well as in general all those excluded by current European Union legislation.
Consumer goods warranty:
In accordance with the General Law for the Defense of Consumers and Users and other complementary laws, all Rocio Gago jewelry has a four-month warranty from purchase. This warranty does not cover possible breakage or wear on the piece or its bath caused by use. The consumer and user must inform the seller of the lack of conformity within a maximum period of 48 hours from when they became aware of it and it is the company together with the workshop that makes the decision to apply for the guarantee.

6.Existence of warranty
All contents (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements that appear on the WEBSITE), unless expressly indicated otherwise, are the property exclusive of Small Affair or third parties.
No intellectual or industrial property rights are transferred to the client over the WEBSITE or any of its component elements, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or use of any nature, by any means or procedure, of any of them, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.

7. Availability of the online purchasing service

Rocio Gago informs the buyer that anomalies or interruptions may occur in the availability or operation of the Service due to causes not attributable to Rocio Gago (technical problems of Internet providers, telecommunications, problems in the buyer's terminal, etc.), therefore that the period to make the purchase may be extended.
8 . International online sales conditions
The same sales conditions will apply as in Spain, except for exchanges and returns.
